These Terms of Service explain how you may use Elavora's website and how enquiries, quotes, and rentals are handled at a high level. They are written to match what we offer: farm equipment rental in Ireland, with clear communication, written confirmations, and practical handover checks.

1. Acceptance and eligibility

By accessing or using this website, you agree to these Terms of Service. If you do not agree, do not use the site. These Terms apply to visitors who browse content and to users who submit an enquiry or request a quote through our contact methods.

You must be at least 16 years old to use this website. If you are under 18, you may browse the site but you must not submit an enquiry or request a quote without the consent of a parent or legal guardian. If you submit an enquiry on behalf of a business, you confirm you have authority to do so.

Equipment hire is subject to additional conditions, including identity and eligibility checks as reasonably required for rental and insurance purposes. Where a separate hire agreement is provided for a specific booking, that agreement will apply to the booking and will be incorporated by reference into these Terms. In case of conflict, the written hire agreement for that booking will take precedence for the relevant matter.

2. Service description

Elavora provides information about farm equipment available for rental in Ireland, including categories such as tractors, machines, and farm tools. The website is designed to help you understand typical use cases, request availability, and obtain a quote. The site does not constitute a binding offer to rent any specific unit.

Availability can change due to scheduling, maintenance, transport constraints, and weather related demands. Any pricing, time windows, and inclusions are confirmed only when we issue a written quote or booking summary. We aim to describe categories accurately, but specifications, features, and attachments can vary between units and may be updated without notice.

We may provide guidance on basic operating checks and practical handover notes. This guidance is general and does not replace manufacturer documentation, site-specific risk assessments, operator training, or compliance obligations that apply to your worksite.

3. User obligations

You agree to use the website lawfully and responsibly. You must provide accurate information when contacting us, including correct contact details, county/location, and hire dates. If you submit an enquiry on behalf of another person or business, you confirm you have permission to share their details.

If a hire is agreed, you agree to operate the equipment only for lawful agricultural and related activities and only by suitably competent operators. You must follow any safety instructions provided during handover and any reasonable operating limitations we communicate. You must not exceed the intended use case, load ratings, or compatibility constraints for attachments and towing.

You are responsible for ensuring that your worksite is suitable for the equipment. This includes access constraints, ground conditions, gate widths, turning space, overhead hazards, and any local restrictions. You are also responsible for arranging suitable storage and security during the hire period.

Where an account, booking reference, or identity verification process is used, you agree not to share access with others and to keep any credentials secure. One account per person is required when accounts are offered.

4. Intellectual property

The website, including text, layout, graphics, icons, photographs (where present), and code, is owned by or licensed to Elavora Equipment Rental Limited and is protected by intellectual property laws. Elavora and related branding are trademarks or trade names used by us.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the site for your personal or internal business use to review information and contact us about equipment rental. You must not copy, reproduce, publish, distribute, sell, license, modify, or create derivative works from the site content without our prior written permission, except as allowed by applicable law.

5. Prohibited activities

You must not misuse the website or attempt to interfere with its normal operation. Prohibited activities include, without limitation:

7. Limitation of liability

To the maximum extent permitted by law, Elavora Equipment Rental Limited will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, business, goodwill, anticipated savings, opportunity, or data, arising out of or relating to your use of the website or any enquiry submitted through it.

To the maximum extent permitted by law, our total aggregate liability for direct damages arising out of or relating to these Terms, the website, or your use of the website, will be capped at the lower of: (a) the amount you paid to Elavora in the 12 months immediately preceding the event giving rise to the claim; or (b) EUR 100.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that Irish law does not permit to be excluded or limited.

8. Indemnification

You agree to indemnify, defend, and hold harmless Elavora Equipment Rental Limited, its directors, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Terms.
  • Your misuse of the website or violation of applicable law.
  • Your infringement of any third-party rights, including intellectual property or privacy rights.
  • Any content you submit to us through forms or messages that is unlawful or violates rights of others.

This indemnity does not apply to the extent a claim is caused by our negligence or wilful misconduct, where such limitation is not permitted by law.

9. Third-party links

Our website may reference third-party services or resources in general terms (for example, manufacturer documentation or mapping services). If we provide links to third-party websites, those links are provided for convenience only. We do not control third-party websites and are not responsible for their content, availability, or practices.

You and Elavora Equipment Rental Limited agree that the courts of Dublin, Ireland will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, except where mandatory laws provide otherwise.

12. Dispute resolution

Before starting formal legal proceedings, you agree to contact us and attempt to resolve the dispute informally for a period of at least 30 days. This informal period begins when you send a written notice describing the issue and the resolution you are seeking.

Notices should be sent by email to [email protected] and, where appropriate, by post to our address listed in Section 15. We will respond using reasonable efforts within that informal period. If the dispute is not resolved within 30 days, either party may pursue a claim in the courts specified in Section 11.

13. Termination and suspension

We may suspend or terminate your access to the website, with or without notice, if we reasonably believe you have violated these Terms, used the site unlawfully, attempted to compromise security, or interfered with the operation of the website.

If you have created an account (where available), we may suspend or terminate the account for the reasons above. Termination may also include restricting access from certain IP addresses or networks. The following sections will survive termination: Intellectual Property (Section 4), Disclaimer of Warranties (Section 6), Limitation of Liability (Section 7), Indemnification (Section 8), Governing Law (Section 11), and Dispute Resolution (Section 12).
